Trademarks

A trademark is a unique identity that makes your company, product, or services stand out from the rest. A registered trademark is your business’s intellectual property/ intangible asset. It protects the investment made into creating trust and loyalty among your customers. Trademark do the advertisement of goods and services itself. Registration of trademark provides the right to sue against others who try to copy or infringement your trademarks and prevents others from using a similar trademark to the one registered by you. There are 45 classes under which trademark can be registered, which is bifurcated into goods trademark (1-34) and service trademark (35-45). Copyrights

Copyright registration is protecting the creative work related to literary, artistic, cinematography, sound, websites, computer software etc. Copyright Act 1957 provides a detailed explanation of the work that can be registered under this. Generally copyright lasts for 60 years and in case of performer’s right it subsist for 50 years. A copyright is a legal right granted by the law to creators. A person get the copyright of your work or creativity as he make it available without any formality. But if you register your work with the Copyright Registry, you do safeguard for your work, in case if someone tries to steal your intellectual hard work. Certificate of registration of copyright and the entries made in the register of copyrights serve as prima facie evidence in a court of law with reference to dispute relating to ownership of copyright. The Protection provided by the Copyright Act, not only protects the creativity of a person, but also it promotes and encourage the people to do more creative work in their respective fields, as they will be in believe that their Intellectual hard work is protected by the law and they have the legal remedies in the case of any infringement or violation of their protected rights. Design

A design is a new and unique features of the product/article such as its shape, composition of colours or line, pattern, ornamentation or configuration in either two or three dimensions as judged solely by the eye. Design/Industrial design is a solely intellectual hard work of a human brain. Therefore it should be, new or original, distinguishable from known design or combination of known design. A design should not contains or comprises scandalous or obscene matter and it should not to be disclosed to the public in India or in any other country in tangible form oy by use or by any other way before filing the application Industrial design are applied to a wide variety of products of industry and handicraft items: from packages and containers to furnishing and household goods, from lighting equipment to jewellery, and from electronic devices to textiles. Industrial design may also be relevant to graphic symbols, graphical user interfaces (GUI), and logos. The owner of a registered industrial design has the right to prevent third parties from making, selling, or importing articles bearing or embodying a design which is a copy, or substantially a copy of the protected design, when such acts are undertaken for commercial purpose. Application for the protection of design should be filed as soon as possible from the date of creation of the design, before it is made public either by use or publication, so that the design remains new at the time of such application. According to The Design Act, 2000 a design registration lasts for 10 years from the date of registration and in can be further extended for 5 years. Like other Intellectual property, Copyright on design can also be transferred by assignment, transmission or other operation of law. FSSAI

Food Safety and Standards Authority of India is an autonomous body and issues the FSSAI License. According to FSSA Act 2006, FSSAI has the responsibility of protecting public health through the regulation and supervision of food safety. FSSAI or better known as food license has become mandatory for entities involved in manufacture, processing, storing, selling, distribution or transportation of food business. In the absence of such license, the entity can be penalized. “Health is Wealth” is not only quote, it is a fact. Hence, FSSAI license sets a benchmark of food quality. The major importance of FSSAI license is that is ensures that food is verified chemically and is safe to consume. There are three types of License • FSSAI Basic License-: If annual turnover of the business is less than 12 lakh, only Registration is required • FSSAI State License-: If annual turnover of the business is between 12 lakh to 20 crore, State License is required • FSSAI Central License-: If annual turnover of the business is above 20 crore, Central License is required. If an operator is running a medium size business i.e. Hotel, Restaurants, Food manufactures, then they are liable for State License. If the food business operator is a large size food manufacturer, then they are liable for Central License. Tenure of FSSAI License is minimum 1 year to maximum 5 years and can be renewed yearly after the payment of License Fee. FSSAI Licence ensure the Trust of Customer. MSME/Udyam Registration

Udyam Registration, also known as a MSME Registration, comprises of a government sign-off provided along with a Recognition Certificate and a Unique Number. This is instrumental if you wish to certify that your small or medium business or enterprises is legal and operational. Udyam Registration is mandatory for business in India, who want the Indian government’s exclusive help during crises. With Udyam Registration certificate business, companies and industries can avail various MSME benefits. The Udyam Registration may also help MSME’s in availing the benefits of scheme of Ministry of MSME’s such as Credit Guarantee Scheme, Public Procurement Policy, additional edge in Government Tenders, Protection against delayed payments & Fees concession for Trademark and for other IP protection etc. An enterprise can be classified as micro, small or medium enterprise and can apply for registration on the basis of following criteria: i. Micro enterprise: Investment in plant and machinery or equipment does not exceed 1 crore rupees and turnover does not exceed 5 crore rupees. ii. Small enterprise: Investment in plant and machinery or equipment does not exceed 10 crore rupees and turnover does not exceed 50 crore rupees. iii. Medium enterprise: Investment in plant and machinery or equipment does not exceed 50 crore rupees and turnover does not exceed 250 crore rupees. Only one Udyam Registration is allowed to one enterprise. However, any number of activities including manufacturing or service or both may be specified or added in one Registration. Currently there is no expiry for Udyam Registration and the same needs to be obtained only once against every PAN. Having PAN & GST number is mandatory form 01.04.2021 for MSME Registration.
